General Terms and Conditions for HughesNet services purchased between January 4, 2011 and November 1, 2012
HughesNet® service is available in the contiguous U.S. with an unobstructed view of the southern sky, is not available in Alaska and Hawaii, and its usage is subject to the Fair Access Policy. Actual speeds vary based on the amount of traffic on the Internet, content on a particular Website, or by the overall performance and configuration of your computer. Stated speeds and uninterrupted use of service are not guaranteed. Actual speeds will likely be lower than speed indicated during peak hours.
Listed speeds are available only through Hughes’ new satellite. The majority of subscribers will have access to these faster speeds. However, approximately one percent (1%) will not be able to receive these speeds as a result of trees or other obstacles that block the signal from the satellite to the site location. In these cases, the Express Service Plans and the Connect Service Plans will not be available.
Professional installation is required. Monthly service fees apply. Taxes not included.
Equipment
You specifically agree that any Equipment provided to you may be new or refurbished as new. Any refurbished Equipment will have the same warranty as new Equipment. If you lease the Equipment from Hughes, during the twenty-four- (24-) month term of the lease, the satellite modem, power supply, and radio (outdoor transmitter) to be installed by Hughes at your premises will remain the property of Hughes (or the applicable leasing company) and shall not be deemed fixtures or part of your realty. During this period, you shall have no right to pledge, sell, mortgage, otherwise encumber, give away, remove, relocate, alter, or tamper with the Equipment (or any notice of our ownership thereon) at any time. You may, however, request a reinstallation, return, or change in the location of the Equipment, which shall be performed by us at our service rates in effect at the time of such service. After the expiration of the twenty-four- (24-) month lease period, assuming you have made all lease and service payments to Hughes in accordance with the terms hereof, you will become the owner of the Equipment, and the applicable lease charge will be discontinued.
Service Commitment
All HughesNet Service Plans require a minimum service commitment of 24 months. If you terminate service prior to the expiration of the commitment, you will owe and your credit or debit card will be charged, or you will be invoiced and responsible to pay, the Termination Fees as described below.
Early Termination: Purchase Option (equipment and standard installation purchased upfront)
If you cancel your order before installation, you will not be charged.
If you cancel after activation but before the end of your 24-month term commitment, you will be charged a Service Termination Fee of up to $400. The exact amount of the Service Termination Fee will be $400 for the first three (3) months after activation of the HughesNet Service. Thereafter, the amount will decrease by $15 per month for each month of active Service.
Early Termination: Lease Option
If you cancel your order before installation, you will not be charged.
If you cancel after activation but before the end of your 24-month term commitment, you will be charged a Service Termination Fee and a Lease Termination Fee. The amount of the Service Termination Fee will be up to $400. The exact amount of the Service Termination Fee will be as set forth $400 for the first three (3) months after activation of the HughesNet Service. Thereafter, the amount will decrease by $15 per month for each month of active Service.
In addition to the Service Termination Fees described in the preceding paragraph, if you cancel your subscription prior to the expiration of the 24-month commitment period, you will also be charged a Lease Termination Fee in accordance with the table set forth below:

Further, you must return your HughesNet modem, power supply, and radio in good condition within 45 days of cancellation date or be charged a $300 Unreturned Equipment Fee ($100 for the modem and power supply and $200 for the radio transmitter).
Early Termination Due to Breach by Subscriber
If your account is terminated by Hughes for non-payment or any other reason, any applicable Service Termination Fee and Lease Termination Fee will be charged immediately upon cancellation.
Price Revision After Expiration of Lease
For Subscribers who have leased their Equipment, upon expiration of the twenty-four (24-) month lease term, assuming all Lease and Service Charge payments have been made in a timely manner and in accordance with the terms of the Subscriber Agreement, you will become the owner of the Equipment, and the applicable monthly Lease Charge will be discontinued.
Credit Card Authorization
YOU AGREE AND ACCEPT THAT HUGHES NETWORK SYSTEMS, LLC (HUGHES) IS AUTHORIZED TO USE YOUR CREDIT OR DEBIT CARD FOR THE PURPOSE OF: (1) CHARGING YOU FOR THE UPFRONT FEES REQUIRED TO RECEIVE HUGHESNET SERVICE, INCLUDING PAYMENT FOR EQUIPMENT AND INSTALLATION; (2) CREATING A HUGHES/HUGHESNET CUSTOMER ACCOUNT; (3) CHARGING YOU FOR YOUR MONTHLY SERVICE FEES AND ANY EQUIPMENT OR INSTALLATION FEES THAT MAY APPLY; AND (4) CHARGING ANY APPLICABLE EARLY TERMINATION FEES.
Networking
For all of Hughes’ Business Service Plans, networking equipment is not included with your HughesNet system. For network setup, support, and configuration, contact your network hardware manufacturer and/or operating system software developer (Hughes is not responsible for network configuration or management).
Please note that all computers on a network will be sharing a single connection. Simultaneous use of high-bandwidth applications by multiple users may result in degradation of download and surfing speeds, and are subject to the Fair Access Policy.
